Terms of Service

1. Acceptance of Terms
By accessing or using any GoldenKall product or service, you agree to these Terms of Service. GoldenKall LLC ("GoldenKall," "we," "us") operates Voco, JobQual, and may release additional products. If you do not agree, do not use the service.
You accept these Terms by the earliest of: (a) signing an order form or service agreement that references these Terms; (b) completing account provisioning; or (c) setting or changing your account password upon your first authenticated login. Your acceptance is recorded together with the version of these Terms then in effect.
2. Service Description
GoldenKall provides autonomous voice agent software for vertical industries. Current products include Voco (restaurant call handling and POS integration) and JobQual (TCPA-compliant outbound recruiting phone screening and ATS integration). Additional products may be offered under these Terms or separate agreements.
3. Eligibility and Account Registration
To use GoldenKall services, you must be an authorized representative of a business and provide accurate account, billing, and operational information. You are responsible for maintaining the security of your account credentials.
4. Your Responsibilities
- Provide accurate data, configuration settings, and integration credentials.
- Comply with applicable laws, including call recording notification requirements and TCPA obligations for any outbound calling.
- Maintain any third-party accounts and integrations you connect to GoldenKall services.
- Use the service only for lawful business purposes and not for fraud, harassment, or violations of privacy.
5. Third-Party Integrations
GoldenKall services may connect to third-party platforms including POS systems, ATS platforms, telecom carriers, calendar providers, and analytics tools. You authorize us to access and use data from those services on your behalf, and you represent that you have the right to grant such access.
6. Call Recording and Messaging
By using GoldenKall services, you consent to call recording and transcription for task accuracy and operational improvement. You also consent to receive SMS messages for service notifications, as described in our Privacy Policy.
7. Fees, Billing, and Payments
Service fees are billed according to your selected plan and usage. All payments are due when invoiced. Unless otherwise stated, fees are non-refundable.
Free Trials. Any free trial or evaluation period is provided strictly "as is" and "as available," with no service-level commitment, uptime guarantee, or warranty of any kind. We may modify, suspend, or end a trial at any time.
Active Subscriptions. A paid subscription does not create any warranty, uptime guarantee, or service-level commitment except as expressly stated in a separate written service-level agreement signed by GoldenKall.
8. Cancellation and Termination
GoldenKall may suspend or terminate your access if you violate these terms, fail to pay fees, or engage in abusive behavior. You may cancel your account by following the account closure process in the dashboard or by contacting info@goldenkall.com.
9. Proprietary Rights
GoldenKall and its licensors retain all rights, title, and interest in its products, software, documentation, and related intellectual property. You retain ownership of your business data and content submitted through the service.
10. Disclaimer of Warranties
The service is provided "as is" and "as available." GoldenKall disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and noninfringement. We do not guarantee uninterrupted or error-free operation.
11. Limitation of Liability
To the fullest extent permitted by law, GoldenKall will not be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost business, lost data, reputational harm, or any missed, dropped, delayed, duplicated, or inaccurately captured orders, calls, or candidate interactions โ whether occurring during a free trial or a paid subscription. Our aggregate liability for any claim is limited to the amount you paid to GoldenKall in the three months prior to the claim.
12. Assumption of Risk
GoldenKall agents operate only when you configure and activate them. By deploying an agent, you acknowledge and accept the operational risks of automated voice handling, including the possibility that a call, order, or interaction may be missed, delayed, incomplete, or inaccurately captured due to telephony outages, internet or power failures, third-party service interruptions, or limitations inherent to automated voice technology.
You are solely responsible for monitoring your service and maintaining an independent fallback method so that you can continue operations if a GoldenKall agent is unavailable or does not meet your needs.
13. Indemnification
You agree to indemnify, defend, and hold GoldenKall harmless from claims arising out of your use of the service, violation of these terms, or infringement of third-party rights.
14. Governing Law
These terms are governed by the laws of Tennessee, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Knoxville, Tennessee.
15. Changes to Terms
We may update these terms from time to time. Continued use of GoldenKall services after changes means you accept the revised terms.
